Tiger Woods’s ex-girlfriend Erica Herman expressed concerns about being left ‘heartbroken and jobless’ in emails from 2017 provided by the golfing icon’s lawyers ahead of the hearing in her lawsuit against him. 

Herman, 38, who dated Woods, 47, for five years, is suing him over an NDA she claims she is being wrongfully enforced on her, citing the Speak Out Act and alleging sexual harassment. 

In a court document filed by Herman’s attorney, Benjamin Hobas, last week, she alleged that the 15-time major winner pursued a sexual relationship with her while she was his employee at his South Florida restaurant and forced her to either sign a non-disclosure agreement or be fired from her job. 

Woods’s lawyers retaliated Monday by filing a motion to compel arbitration in Martin County, Florida, submitting new court documents obtained by DailyMail.com. 

The documents include a full copy of the unredacted NDA and alleged email communications between Herman and the golfer’s team discussing the implications of her job.

Herman was regularly spotted attending events such as the Ryder Cup with Woods 

Herman expressed concern over being left jobless should her relationship with Woods come to an end in an email chain from August 2017.

‘My only concern is if by chance TW does something that brings our relationship to an end, do I automatically loose [sic] my job?’ she wrote in an email to Chris Hubman, CFO of TGR Ventures. 

‘I don’t have any problems with what’s in the document because I wouldn’t go public or use anything I know to hurt him or the kids but with my whole life in his hands now I would want to have some kind of control over my future in the business.

‘If something happened 5-10 years down the road I don’t want to be in my 40’s heartbroken and jobless. Thoughts?’

Hubman assured her in his response that her employment at Woods’s restaurant, The Woods Jupiter (TWJ), and her personal relationship with the PGA Tour star were ‘two separate items’ and the NDA didn’t ‘address the terms of your TWJ employment.’

The documents show Herman indicating she understood before allegedly sending Hubman a signed copy of the NDA, dated August 9, 2017. 

Woods also claims that he can verify that the signature on the NDA is Herman’s as he became ‘familiar with her signature and handwriting’ over the course of their relationship. 

By allegedly signing the document, Herman agreed not to disclose private information, including communications, photos, videos, health, medical and sexual matters, to anyone, including her friends and family.

Herman now wants the court to determine that the NDA is invalid or unforeseeable for reasons, including that she claims she was subject to sexual abuse by him. 

In the case, filed in March, to void the NDA, Herman made the startling allegation that the 82-time winner on the PGA Tour had sexually abused her but went into no detail as to what the alleged abuse entailed. 

However, Woods is attempting to steer the dispute towards private arbitration in order to avoid a trial by judge, claiming it is in accordance with the NDA they both allegedly signed in 2017.

His latest filing shows that the attached signed copy of the alleged NDA seemingly supports his argument. 

The document states: ‘Each of Us understands, acknowledges and agrees that by agreeing to arbitration, We are giving up any rights We may have to a trial by judge or jury with regard to the matters which are required to be submitted to mandatory binding Arbitration. 

‘We also understand, acknowledge and agree that there is no right to an appeal or a review of an Arbitrator’s award as there would be a right of appeal or review of a judge or jury’s decision.’

In Herman’s filing on Friday, her attorney noted that Woods did not try to take their breakup dispute to arbitration when he kicked her out of his house in October 2022.

‘Instead, he called a California attorney — who promotes himself as “Ray Donovan with a pen” — to unceremoniously eject Ms. Herman from the house through trickery and break up with her for him,’ said the document. 

Ray Donovan is a television character, who is a professional ‘fixer’ for the rich and famous.

Herman filed a separated lawsuit last October against the Jupiter Island Irrevocable Homestead Trust, which is the legal owner of his mansion in Hobe Sound, Florida, where the two lived together.

In the separate dispute, she is suing the trust, that she claims Woods controls, for $30million, alleging that he tricked her into leaving the Florida mansion where they had lived together for six years following their breakup in October.

She claimed that she had an oral agreement with Woods’s trust – the Jupiter Island Irrevocable Homestead Trust – that allowed her to live at the property for 11 years.

The complaint says that she provided ‘valuable services’ at Woods’s requests as part of the ‘oral tenancy agreement,’ which gave her the right to live at the property for a ‘certain duration of time.’

But Woods’s attorneys dispute that he never negotiated a written or oral tenancy agreement with her and that she lived at the property as a ‘guest’ of the golfing icon.

They also noted that Herman had not asserted any claims for sexual assault or sexual harassment in that particular landlord-tenant action but had in the dispute over the NDA. 

Woods is said to be ‘terrified’ of the lawsuit over concerns of ‘another scandal’ after his career was almost derailed by a cheating scandal in 2009. 

Woods and Herman were together for six years after being first spotted at the Presidents Cup in New Jersey in October 2017. 

Once they started dating the two became inseparable, with Herman regularly supporting him at golf tournaments.

Rumors first began swirling about them after Erica was seen wearing a ‘player spouse’ badge, usually given to wives and girlfriends.

The following month, they went public about their relationship.

Woods’s lawyers state that he broke things off on October 13, 2022.
